Why can the titles not be compared between firms?

Because each firm writes its own ladder, and the incentives point in different directions.

A large firm with several hundred lawyers needs many rungs to mark progress over a long career, so it may run two associate levels and two partner levels. A six-lawyer firm may run two rungs in total and call everyone else a lawyer. Neither is wrong, and a senior associate at one may have been practising longer than a partner at the other.

Two things follow from that, and they are the reason this page exists rather than a chart:

  • A title is not a qualification. Admission to practise is the qualification, and it happens once, early. Everything above it is an internal convention.
  • A title is not a promise about who does your work. The named person on a matter and the person drafting it are frequently different, which is a reasonable arrangement and worth asking about rather than assuming.

What is special counsel, and is it Australian?

It is a senior non-partner rung, and it is the standard Australian name for a role British firms more often call legal director or of counsel.

The usual shape is a lawyer with genuine depth in one area who is not on the partnership track, either because the firm has no room for another owner in that practice or because the lawyer does not want the management and business-generation load that partnership carries. Where it sits relative to senior associate and partner is again the firm's own decision, and some firms run it as a parallel track rather than a step.
