The last row is the whole page. Everything above it follows from the fact that one of these two disciplines is a purchase and the other is a habit somebody at the firm has to keep.

The damaging admission, before anything else: we sell only the left-hand column, and we cannot do the right-hand one for anybody. No supplier can. The relationships are personal, they are not transferable, and a supplier offering to develop a firm's referral network is selling a database, a list, or somebody else's contacts under a different name.

Why do firms under-invest in the second?

Because nothing about it arrives as an invoice, and budgets are built from invoices.

Marketing has a line. It gets approved, it gets reviewed, and somebody has to defend it in the quarter it produces nothing. Business development has no line, so it is never approved and never reviewed — and never protected either. When a fee earner's week compresses, the first thing dropped is the call that has no deadline attached.

There is a second reason, and it is more uncomfortable. Business development is done by the people who are also the product. An hour spent on a coffee with a referring accountant is an hour not billed, and it appears in the firm's own reporting as a cost with no matching entry. Marketing spends money that was never anyone's chargeable time. That accounting difference, and not any judgment about effectiveness, is what decides which of the two gets attention.

Where does the work actually come from when search cannot supply it?

In some practice areas the search market is too small to be an acquisition channel at all, and the figures say so plainly.

Read the Boston row. The entire monthly search market for a business attorney in that city is worth less than half our build tier. That is not an argument for spending nothing on the site; a person given the firm's name still checks it. It is an argument that in commercial work the introduction is the acquisition channel, and search is the verification step afterwards.

That is a statement about search volume and nothing else. We did not survey how commercial work is actually introduced in any city, and we are not going to publish a share.

What does a business development routine actually consist of?

Four things, none of which needs a budget and all of which need somebody's calendar.

  1. A register of who introduced work. Every matter opened in the last twenty-four months, the person or firm who sent it, the matter type, and whether anybody ever acknowledged it. The register answers two questions most firms have never put in writing: which names account for the most work, and which of them were never acknowledged.
  2. A note, quarterly, to each name on that register. Two sentences: what the firm is taking on at the moment, and what it is not. The second sentence is the one that produces introductions, because it tells a referrer what to stop sending as well as what to send.
  3. Reciprocity in the direction that costs you nothing. Matter types the firm does not want are worth more given away deliberately, to a named person, than declined by email.
  4. The closed-file list. People whose matter finished well and who have never heard from the firm since. This is the cheapest group in the building and the one nobody owns.

None of the four is difficult. All four are the kind of work that only happens if a specific person's name is against it, which is why firms that take business development seriously usually give it to one partner rather than to everybody.

How would you know whether either of them worked?

Marketing leaves a record. Business development leaves one field, and most firms do not fill it in.

Everything on the marketing side is counted whether anybody looks or not — impressions, clicks, which page produced which inquiry. The business development side has exactly one measurement available: asking every new client who sent them, and writing the answer down. That is a single field at intake, and a firm without it cannot say what produced last year's work, which means it cannot decide where to put this year's effort either.

We do not fix intake. It sits inside the firm, and a supplier claiming to solve it is describing software or a call center. But this field is the one that decides whether either discipline can be judged, so it belongs in the conversation before any invoice.

If the firm's constraint is introductions rather than strangers, that is a more relevant purchase than a website.
